I went to pick up my six year old kindergarten daughter at McLouth Kansas Elementary. I had not seen her for about four days due to a recent separation. As soon as my daughter got into my car she said, "Dad, I have something very, very bad to tell you." I told her she could tell me anything. She says, "Dad, a boy made me go into the boys bathroom." Of course, I immediately asked, "Did you tell your teacher?" I was thinking it was a fellow kindergartner classmate. She says, "I wanted to but I was so scared." I told her, "I will talk to the teacher tomorrow before school." She states, "Mom already has." I asked her, "When did this happen?" My daughter says, "I think a few days ago. I'm not sure." Remember she was only six and time is difficult for some children at this age.
I said, "Your mom already talked to her? What did she say about the boy making you go into the boy's bathroom?" She says, "No! She talked to the teacher about him bothering me in the library." She said, "He patted me on the butt and has been bothering me trying to talk to me." I asked her if he was in her class and she said, "No! He is in Jon's class." My son Jon was a sixteen year old high school student. That moment, realizing the age and magnitude of this, was enough to give a father a heart attack. I said, "A sixteen year old boy made you go into the bathroom." As tears are coming to her eyes she said, "He made me, Dad." At this time we arrived home.
As we were getting out of the car I asked her if she knew who it was. She said it was a kid her brother knows. She said, "He put his arm around my neck." I asked her if he choked her. She said "No! Like this." She walked behind me and had me bend down. She put her arm around my neck in a back choke hold and said, "Like this." She then said, "He lifted me in the air where it was hard to breathe." To make matters worse, she said, "He dragged me into the bathroom and put his tongue in my mouth. He tried to take my pants off. He saw my panties but couldn't get my pants off because my belt was on too tight. I kept kicking and fighting and poked him in his eyes. He dropped me and I ran out to my class." I asked, "Did you tell your teacher?" She said, "Dad, I was so scared I wanted to hide under my desk. I was shaking really bad."
I was very angry at that point and asked, "Why didn't you tell someone?" She had tears rolling from her eyes. She said, "Dad, I was so scared. I already told the teacher once, I don't know". I realized, in that moment, she had the look of a girl that was ashamed, as if she had done something wrong. I couldn't imagine what a six year old was experiencing mentally, especially when most adults surviving an attempted rape have years of pain and suffering. I took her immediately to the McLouth Police Department.

We reported the Incident to the on duty Officer Patrick Johnson. We were asked to come back the next day. Arriving the next day, Summer's mom and I talked to Officer Patrick Johnson and a Jefferson County Sheriffs Officer separately. We were sitting in the McLouth City Hall entrance area. People coming in an out of City Hall could hear everything through the door of the Police Office. It was very uncomfortable. I told Officer Johnson that this student was known for not being very clean and his clothes where usually dirty. I asked if he could ask to look at his jacket to see if any of my daughters hair was on it. I was told by Officer Johnson this was not an episode of CSI that they don't do that. Recently taking a Private Investigator's course, I could not believe what I was hearing. I asked, "Are you sure? She has long hair that sheds everywhere." He smirked and said, "NO!" as if I was an idiot for asking.
My daughter had identified the attacker from a year book photo. Summer consistently identified this guy. One year book did not have this guys photo, only his twin brother. Summer stated he is not in these pictures. Summer was then given an up to date year book and she pointed this guy out immediately. It turned out to be the same person that had earned a reputation for being handsy with kids on the school bus. This was the same bus that picked kids up at our rural Jefferson County residence. Earlier in the year with the rising fuel cost we had looked into putting our daughter on the local bus route. We were warned that some new kid was doing inappropriate things to kids on the bus. We chose to play it safe and not allow our daughter to ride the bus with her bestfriend. Her attacker had recently moved to the area and changed his name.
Officer Johnson asked us to take our daughter to the hospital for a rape kit. We where confused of this request because she had fought it off but went ahead with his request. Upon arrival and hours of waiting, the on duty doctor was shocked as to why a Police Officer would send a child there for a rape kit test when they had fought it off and it had been days.
We met with a State Forensic Specialist that interviewed and confirmed that an attack took place. Officer Johnson was present but McLouth Police Chief Koch stood up and said "Well, I'm going home!" before the interview was performed. I was shocked that the Chief would leave this up to what I thought was a DUI Traffic Officer. We were advised to get our daughter back to school before she started blaming herself for reporting the attack.
Officer Johnson stated he had a lot of school video footage to go through to see if the attack was on video. I asked, "Why go through all those videos when we can take my daughter to school right now to show the exact bathroom she was attacked at?" Officer Johnson said that would not be a good idea. I was confused why he would not want a victim to show them where her crime took place. I said maybe they could get some finger prints from the bathroom to at least put the attacker in the area. Officer Johnson said, "No!" with that familiar smirk again. I asked, "Are you sure?" He said, "Yes!" As I was walking out the door Officer Johnson turned and said "Oh, yeah! Don't go to the media with this". I was confused why he would say something like that, especially in the small town of McLouth. I was not pleased at that moment with Officer Johnson. I knew that time was not on our side and crucial evidence needed to be recovered but the actions of this Officer were as if he did not know what he was doing.

Meeting with School Officials
I called (former) Superintendent Jean Rush to setup a meeting but was shocked to find out she had no clue what I was talking about. I told her, "You have had Police Officer in your building getting video tapes and investigating the attack of my daughter and you have not been informed after nearly three days?" She states "I will look into it and see you at a scheduled meeting".
Arriving at McLouth elementary for the meeting with Superintendent Jean Rush, High School Principal Mike Bogard, and (retired) Elementary Principal Butch Batman:
Immediately, Jean Rush tries to down play that she did not know about the near rape of my daughter. I confronted Elementary Principal Butch Batman about the incident involving my daughters attacker. Students claimed he was found holding a elementary kid in the bathroom crying. Principal Batman didn't deny it but rather he said, "They where horse playing". I exclaimed, "Horse playing?" Some students claimed he was in the stall holding the kid who was crying. According to a statement directly made by the attacker: His own words were "I was just trying to comfort him". HIM? I asked, "Why was he in the elementary bathroom?" Principal Batman went quiet.
High school Principal Mike Bogard took the meeting over with a very negative attitude. I asked if we could just put some safety measures such as expandable gates to separate the High School from the Elementary until Police were done with the investigation. Principal Bogard went into defense mode and said, " I don't see that happening". As his attitude went to arrogance he said, "I don't see how this could happen". He said, "For all we know, your daughter could have walked into that bathroom." As if she deserved to be attacked! I got up and stormed out of the building. Principal Bogard followed me out to the parking lot saying, "We can work this out". I said, "You had your chance!"
Jean Rush was leaving at the end of the year and elementary principal Batman was retiring also. Is it Superintendent Jean Rush's fault she was not notified of the incident? I think this is a clear example of a disorganized school system.
School Board Meeting
I spoke with the McLouth School Board and explained what had happened to my daughter. When I was done they just sat there and didn't say a word. I left without the board asking any questions.
McLouth Police Pending Investigation
Two weeks had passed when Officer Johnson pulled my vehicle over. He advised me that the County Attorney wanted to have my daughter interviewed again. They had previously told us that she would only have to do it once and it would be used for court. Since my daughter was a minor they could use the video this way the children can start the healing process. They said she was embarrassed on parts of the video and whispered and wanted more of an audible response. I agreed. I later found out it was Chief Koch who wanted the video re-done. Remember he went home on the last video and left it up to Officer Johnson.
My daughter had already been forced to start a new school and we had been working to free her mind of this nightmare. Now she had to go all through it again. In this next video interview she had stated a friend had her butt patted by this attacker, also. The friend also did a video and later found out from the County Attorney she did not recall the incident. I would like to address this. This is what happens when mistakes are made by Law Enforcement. Our daughter was to only do one interview. We had spent half a month trying to let her heal. She would cry herself to sleep saying she missed all her friends and best friend. Her best friend was the friend who she stated was patted on the butt, also.
Did this girl really not recall the incident? Did the parents not want any part of their daughter being brought into this? Was she scared of this child pedophile because she had ridden the bus with him all year? Did my daughter miss her friends and start blaming herself for telling and said this to ease her pain? We will never know. They were six year old girls. To consider dropping charges from this, after a State Forensic Specialist confirmed the attack, I would say is out of the question.
Sheriff Jeff Herrig Contacted
After 30 days of waiting and no update or courtesy call from McLouth Police on how my daughter was doing, I called Police Chief Koch. I asked why the Investigation Report was not done and he stated they where waiting on paperwork. I explained that this student that attacked my daughter was walking the school freely while their Department was waiting on paperwork. I also explained my son was in the same grade and said this student was still getting passes to go to the library, the same location my daughter was attacked. Chief Koch said he did not have jurisdiction over the school. I said, "If a rapist attacked your wife and jogged by your house every night wouldn't you be upset that the Police Department sat for 30 days on the Investigation?" It was obvious we were not finding any common ground.
I called Sheriff Herrig and explained my concern of how McLouth Police was handling my daughters case. I asked if the Jefferson County Sheriff's Office could take the case over. I told him, "This is your county, you're the big dog." Sheriff Herrig stated he would look into it.
Sheriff Herrig made an announcement to the Oskaloosa Independent (newspaper) that charges should be coming soon. The student that attacked my daughter was taken into custody. After ten days he was then released with all charges dropped. County Attorney (former) Robert Fox called me in for a meeting.
Jefferson County Attorney's Office
I arrived at the County Prosecutors Office. County Prosecutor Fox said he was not calling my daughter a liar but he had several concerns.
1.) He said my daughter's mom told her teacher two different stories on two different days of what happened prior to the attack. I explained that she had only met with the teacher once at parent teacher conference. I also stated that all staff at school is in defense mode because of there legal liability to keep my daughter safe.
2.) Mr. Fox said my daughter's mom told Officer Johnson of the McLouth Police Department that my daughter had told her of three different accounts of what happened at school including one . . . that the attack could of happened on the school bus. I immediately stated that before we went into the Police Station we were asked by Officer Johnson to keep an eye on her and to see if her story changed. We talked before going into the Police Station to see if my daughter had changed any part of her story. My daughter was very consistent with her accounts. I explained that during her mom's only interview with Officer Johnson I was outside the door and heard everything. She never stated any of those accounts of three different stories. I also stated that to show this is not true my daughter had never ridden the school bus, EVER! I asked why would she state that when we drove her to school everyday. I asked if he had these accounts in writing and he stated yes. He lifted up a folder of papers and I asked to see them. He said they're in here and pulled the file away without showing me.
3.) Mr. Fox then shows me a layout of the school's bathrooms. He showed me where cameras were located and where cameras were not. He said the two sets of bathrooms, where it could have happened, had cameras and there was no video of the incident. He pointed to the only bathrooms without cameras and said there was no way it could have happened there because someone would have seen it. I asked him if the videos where dated and timed. He told me, yes. I told him Officer Johnson would not allow my daughter to go to school and point out the restroom where it happened, which was concerning.
I stated that if my daughter was allowed to identify the bathroom they could get the last two weeks of video, in case the incident happened earlier, since my daughter never stated an exact date. I also stated that the bathrooms without cameras could have been used. This student had already been busted in one bathroom with an elementary kid and he could have waited for the perfect time and place, including this location, to do his attack. I said, "Never say never. Nothing is impossible!"
4.) Mr. Fox said my son had sent a text to a girlfriend stating that his sister was raped. I asked how did that have anything to do with this case? He said it complicates things. I asked, " "How did you get a text of my son's phone and can I see it?" He said the Officer stated it in his report. I said my son is sixteen and I can’t speak for the way High School kids think. I said rape, attempted rape, or sexual assault . . . he is a kid that does not understand legal terms.
5.) Mr. Fox goes on to say my daughter stated a friend had her butt grabbed also but her friend denied this account. I explained this girl had ridden the bus all year with this alleged student and currently still rides with this student. I told Mr. Fox that naturally a kid would be scared of retaliation, especially a six year old telling on a sixteen year old that's 6ft tall and weighs 200lbs. I explained that younger kids already are sitting at the front of the bus because of this alleged student's actions on the bus all year.
6.) Mr. Fox then states your daughter made a statement that this student had been staring at her at lunch. He said she only could have heard this from me because these kids don’t eat together. I stated that students, including my son, say that elementary kids line up in the hallway for lunch. I told him it is at this time that the student that attacked my daughter makes his comments that fifth graders are cute and eyes young girls according to student accounts.
Mr. Fox is angry at this time and says he has an ethical responsibility to drop charges. I said, "Didn’t you have an ethical responsibility before arresting a kid at the High School without enough evidence? Mr. Fox said he jumped the gun and should have looked into the reports more clearly. I stated, "You had the reports for 45 days. How much time did you need?" He was upset with my presence and stated if I was not happy I could go to the Attorney General. I explained he had to request that. He said if you’re not happy you can go there. I’m dismissing the charges.
I called my daughter's mom to find out Prosecutor Fox had called her before I went to see him. She said Mr. Fox told her he was dropping charges because my daughter could not handle the defense attorney Mike Hayes in court. I explained what he told me and she cried. She didn’t understand why he would lie about her statements and then tell her a different reason of why he was dropping charges. I headed to the Kansas Attorney General’s Criminal Division.

I met with Jefferson County Sheriff Herrig. I explained my concerns of why charges where dropped. I asked, "If this evidence was this bad why did you go to the paper to say charges should be coming?" Sheriff Herrig admitted he didn’t look the case over as he said he would. Sheriff Herrig stated that he took the word of the McLouth Police Chief Koch. I stated my early concerns of the progress of the case and contacted him to, please, look the case over to assure everything was properly done. Sherrif Herrig admitted he didn’t do anything and took the word of Police Chief Koch.
At this moment I was very disappointed. Sheriff Herrig, before charges where filed, stated his office would look into the case due to my concern that McLouth is a small town and officers don’t experience this type of incident regularly. The Jefferson County Sheriff’s Office has more resources and detectives available. Sheriff Herrig had said they looked into the case early on but then comes forward admitting he did nothing. I left devastated with disbelief. They swore an oath to protect and serve. An oath now broken!
I met with Police Chief Koch. I stated County Prosecutor Fox’s reasons for dropping charges. I confronted Chief Koch that County Prosecutor Fox claimed that reports from his office presented several statements that were false and impossible. I told him my daughter's mom never filed a police report out with this alleged false information.
I voiced concern on why my daughter was never allowed to identify the bathroom where she was attacked to be 100% sure where it took place. I continued to explain the importance of securing video for the last two weeks because my daughter never gave an exact date of when the attack took place. The school may dispose or record over if not requested. Chief Koch seemed taken off guard with the alleged claims his department made in police reports. Chief Koch assured me he did a complete investigation and does not get involved with small town politics. He stated he does not get emotionally attached to cases and runs a professional department.
Kansas Attorney General's Office
The Attorney General's Office explained they must be asked by the County Prosecutor to enter the case. They did take my documented report of my daughter's case and responded back later stating there concerns of how the school handled it. The Attorney General said they forwarded it to the McLouth Police for investigation. I sent an email to McLouth Police Chief Koch stating we had students willing to come forward with incidents at school involving my daughter's attacker. To date, Police Chief Koch has never responded or asked for any information. I ask you to think about this. McLouth School children have many accounts of a new student doing innappropiate things to kids and first hand accounts of statements made by this guy.
The Kansas Attorney General was concerned enough to ask that it be investigated. The McLouth Police Department never called or emailed for this information. ARE YOU SERIOIUS? This should outrage a community and should be grounds for immediate termination. I have confirmation of my attempts and email to Chief Koch. The question is: Why did he never respond if he did a complete investigaton? We are talking about a child pedophile loose in our school with access to our children.

I received a letter from the Kansas Attorney General stating that they where going to forward there concerns
of how the Mclouth USD 342 handled my daughters case to you for investigating.
Speaking with SRS, State Senators, Governors Chief legal Counsel and the majority of Jefferson County
residents I have spoke with, the most common concern is the previous incidents at school prior to my
daughters reported assault.
Students at school report this alleged student was suspended for inappropriately touching kids on the school bus.
According to state officials this should have been reported to SRS and law enforcement.
Principal Batman reported in our conversation that he did find this alleged student in the elementary
bathroom with a 3rd grade boy, Batman stated they where horseplaying.
According to students the alleged student was suspended for holding a 3rd grade boy in the bathroom stall
crying. Why is a high school student in the elementary bathroom?
The girl my daughter stated was also touched by the alleged student, rode the school bus with this alleged student all year up to my
daughters reported incident. A student, especially 6 years old would be in fear of telling on such a incident. Same as telling
on the school bully. It did not help the case but fully understandable.
This case has reached the accountability phase. I hope some of the above accounts can be looked at and a
explanation given. If denied there are students willing to come forward to state what they know.
If I can be of any help let me know. I do not know if I'm allowed to know of any progress of this type
of investigation, if legally available I would like to know.
The Community is full of so much information involving this alleged student and his prior history leading
up to my daughters reported assault.

In attempts to make sense of what had happened, I thought if I could get the McLouth City Prosecutor to look into the case he could see if County Attorney Robert Fox's reasons for dropping the case had any truth. I have always believed there is something in the reports they don't want people to know involving small town politics and backroom deal making. I figured this would be a great opportunity to put to rest . . . Did McLouth Police do a thorough investigation or was it full of mistakes?
The McLouth Police Department would have a chance to earn their honor and respect back with my family. I called McLouth City Prosecutor Trevin Wray to see what his opinion of the case was and to see if he could file misdemeanor charges as a City Prosecutor. I also wanted to know if a City Prosecutor could request the Attorney General. He said he would look into it and stated that he could ask the Attorney General to enter the case if he saw any felonies (he denies this statement now).
I contacted City Prosecutor Trevin Wray again by phone. He was immediately clear his time was limited and his tone let me know his decision of helping was 'NO'! He stated this case involving minors made it difficult to prosecute. He first said he looked at limited available reports and then stated, minutes later, that he couldn’t get reports due to his jurisdictional restrictions. I let him know I was disappointed and just wanted someone to get this case to the Attorney General before valuable information was lost. I asked him if he thought the McLouth Police did a thorough job? He said he was impressed with what he was shown. I asked him if he didn’t obtain reports then how would he know that. There was dead silence over the phone. I said thank you sir and ended the phone call. I attempted to change his mind by emails but never succeeded.

My son, within a couple of weeks, was stopped by Officer Johnson. On one occasion it was for speeding and the second occasion was for driving down the center lane of road. This was a kid that had never been in trouble. He was a volunteer firefighter, going to McLouth High School fulltime, and working a job. I was concerned of the timing with the intent of a lawsuit being sent to McLouth Elementary on my daughter's case and the traffic stops.
I called Mayor Keith Meador with my concerns. I signed up to speak with the City Council of McLouth to address these issues. I had to call Mayor Meador again after my son was pulled over days later again by Officer Johnson. I left a voicemail to let him know I was not going to tolerate my son being harassed. Days later my son received a letter telling him he was being dismissed from the Jefferson County Volunteer Fire Department for reasons of attendance that had never been an issue before. They knew he had school, work, and going through a difficult time with his sister's attack at school. This was the same Fire Department that a relative to my daughter's attacker worked. The timing in my opinion was suspicious with Mayor Meador and his work with the McLouth Fire Department, the recent call I had made, and the traffic stops. Driving down the center lane of South Union road is not illegal. There are no center markings, its a small road barely big enough for two cars, and maintained by the county, last check.
South Union Road Mclouth Kansas. Traffic stop was made by Officer Johnson for being in center of lane. No center line markings and leads to gravel road to our property. Did Officer Johnson make a lawful stop? Every vehicle traveling this road on 11/10/2012 was in center lane from 11:30am to 12:30pm. Here is a teenage boy with no criminal history, volunteer firefighter, fulltime student, and holding down a parttime job. Would you want your child sitting at night, on a gravel road alone , with a new Police Officer in his probationary period, that has already had a complaint made to the Mayor of his conduct?


I arrived at McLouth City Council meeting to address concerns. I was met with: "The McLouth Police Department is a law abiding department", with City Councilman Woodring nearly coming out of his seat stating his Officers were the best and would not tolerate their actions being questioned. I then went to address my daughter's case that had charges dropped based on some conflicting statements in the McLouth Police reports. I asked for the McLouth City Council to take a vote to ask the City Prosecutor to at least look into the case to see if any misdemeanors could be prosecuted and if they saw a felony to request the Attorney General. City prosecutor stated he couldn't request the Attorney General.
Mayor Meador went on to state that the County Attorneys Office already made its decision. I said, "From your Officer's reports, I asked for a vote to ask the City Prosecutor to look into case". I knew this would be a opportunity to have reports looked at to see if indeed the McLouth Police reported all these mis- statements and out right lies or was the County Attorney's Office throwing the McLouth Police Department under the bus. Mayor Meador stated clearly the County Attorney's Office made it's decision. I stated, "If this was your daughter, you would not be saying that." I added, "I can't even look at the McLouth School because I picture my little girl's legs dangling in the air fighting off this guy." The City Council sat silent with no one raising there hand in support of my daughter. The Mayor seemed to not understand the County based it's decision to drop my daughters case from reports given from his hired Officers, The McLouth Police Department. The Police are not elected or hired by themselves. The City of McLouth gave these Officers the opportunity to serve McLouth and they can also terminate those same Officers.

I had read non elected County Attorney Robert Fox had left and a new County Attorney was to serve out the remaining term of Caleb Stegall. I new this would be a great opportunity to get to the bottom of what was going on with my daughter's case. I figured with a new set of eyes, maybe we could get some kind of explanation of what really happened. I went to meet County Attorney Jason Belveal. I sat and explained I was concerned on how the McLouth Police Department handled my daughter's case and wanted the Attorney General to enter the case. I was immediately told that was not going to happen. I had not even stated the issues and false statements that had been given for dropping charges.
Our Attorney General only needed the word' yes' and my daughter could at least have a real oppurtunity for justice. A unbiased and thorough investigation done with experienced investigators. I realized at that moment the children of Jefferson County are lacking a leader. Someone that will pursue justice and turn over every stone to guarantee their safety.
Imagine if this would have happened to a relative of Sherriff Herrig, McLouth Mayor Meador, the attackers attorney Mike Hayes, County Attorney Robert Fox (Jason Belveal), or any of these elected Officials. They would have prosecuted this to the fullest. What the children of Jefferson County, Kansas have been left with is this: If you don't have a video or DNA, there will be no prosecution.
I'm here to let each and every child of Jefferson County, Kansas know that I will never stop fighting to get my daughter justice and to reform the way these attacks are handled. I may be hated by our elected officials but in the end a true leader will come to realize the good I'm trying to do. It's going to be a long hard battle. I will give you a voice and let any rapist or child pedophile know: Don't ever think of hurting a child in Jefferson County, Kansas. This fight will be finished at the Kansas State Capitol. We will get the law changed and put the resources needed to prosecute these crimes with the lead investigator being the Kansas Attorney General. I admire people like John Walsh that never gave up on his son. To fight against all odds like he did, to change the laws to protect our children, and change the way Law Enforcement handles cases.
To the animal that attacked my daughter.
The little girl that walked the hallways that day so innocent to the world, the little girl that still believed in Sponge Bob and wanted to be a Princess, the moment you wrapped your arm around her neck instilling fear she had never experienced you robbed her of her innocense to the world. Your plan had one big flaw . . . you messed with the wrong little girl. That girl's Daddy is Terry Snell. This is the father that swore to protect his daughter at all cost. I'm relentless in the pursuit of justice and I don't ever lose without a fight. I'm not intimidated by any elected Official and will hold them accountable when you strike again. I will be there front and center when you hurt another child to let the world know what you and each elected Official from Jefferson County Kansas did to my daughter.
When you do finally reach prison and they know what you did, I want you to remember this: A 38 lb. 6 year old girl kicked your butt and exposed your sick ways. Your secret is out and it's only a matter of time the cuffs go on.
If you are calling these officials, here are some questions, they cannot answer.
1) If you called both Mclouth Police Officers to the County Attorney's Office and asked them to point out the Bathroom of attack. Why would they not beable to identify the exact bathroom?
2) County Attorney Jason Belveal, you stated in paper school video shows no attack. If you dont know were the crime scene is, what video are you looking at?
3) County Attorney Jason Belveal, how did the Mclouth Police department do a thorough investigation when they didnt even identify a crime scene not alone seek any physical evidence.
4) Mclouth Police Chief Koch, you state in paper, you do not decide who gets charged. Is it true, you submit a Police report, from your department, to the County Attorney? That information is used as evidence to bring charges against an alleged criminal. If you submit a report without identifing a crime scene, with no physical evidence, do you think you had a role in charges being dropped on a child pedophile?
5) Sheriff Herrig, you stated in paper, in April 2011 you and the Mclouth Police wrapped up an investigation on this attack and assume charges will be coming. Father of victim states you said you would look into case upon his request 6 weeks into investigation. Father states you then recant your statement and did not look into case after charges were dropped. Sheriff Herrig you then state to Paper in Jan. 2013 you wanted to make clear you did not look into case. Sherrif Herrig what is your Official answer? 2 conflicting statements in newspaper. Please state which paper lied and if you requested the error to be fixed.
6) Mclouth Kansas Mayor Keith Meador, why would you refuse to let the City Prosecutor look into a case involving many concerned actions by your hired Police Officers. As mayor you are the man in charge of hiring these Officers.
If your child was attacked, denied Justice, on many un-explained actions of a Police department, would you want the local mayor to state" the County made its decision, no help from the City"? Does it concern you of these very valid facts of how your hired Officers handled this case? Do you feel the citizens of Mclouth deserve to have their towns name tarnished because your refusal to look into a attack of little girl at school and how your Officers handled the case?
UPDATE: County Attorney Jason Belveal stated, in the Lawrence Journal World 1/13 2013, "he does not think the attack happened". In the same article he states" though he has not seen the video footage from the school". On 1/4/2013 Topeka Capitol Journal, 1/7/ 2013 Topeka 13 News ,he stated that he had viewed the same evidence as former County Attorney and reached the same conclusion. Now he has stated he has not viewed the video, after these question were released to website to ask.
What makes his statement more insulting is this was Summer's Birthday weekend. The County Attorney is implying she is a liar. He is finally in a corner unable to answer questions. He decides to make a statement like this after stating he has not even looked at the video. I can reassure everyone reading this, I personally sat in front of County Attorney Belveal and he stated very clearly he watched the video. This was his reason for not moving forward with case.
If your a County Attorney, a father wants the Attorney General to enter a case because of concerns of the way it was handled. The father puts a youtube video out with over 30,000 views in 2 weeks. All local news stations are reporting on case and asking for statements from your office. The County Attorney's Office has stayed firm on the video shows no attack of why charges were dropped. As County Attorney, you want people to believe, you have not looked at the video but your confident enough to make a bold statement of "I dont think the attack happened". Telling a little girl, that is a victim of a horriable attack, still healing from that attack, in her home town paper, that she is a liar is, is very unproffesional.
As County Attorney you have no problem with Child Pornagrapher getting probation but can call a little girl a liar without reviewing all evidence. The little liar plays her part so well in public at 6 years old. Urinating her pants in Walmart because the family bathroom was full and was to scared to go into the girls bathroom alone. Her pride beat down, innocense taken, and now this statement. As Summer's father ,I would never wish this upon your family. I wish we had the same respect from the Jefferson County Kansas Attorney's Office.
County Attorney Jason Belveal, you have lied and need to apologize to Summer for that statement. Its hard to mis lead retired police officers and private detectives inquiring about this case. The days of the video shows no attack are over, pick your reason and stick with it. I have facts and have always stood by them. If new evidence showed up tommorrow, how would you proceed with this case after a comment like that? If you have a video of Summer walking safely to and from class, release it. As Summer's father I give you permission to release a video of my daughter. Then release a copy of Police report stating were attack took place and how they identified the location of attack. If you do not think attack happened, back it up with facts.
